Convention

Description des travaux :

À moins de dispositions contraires, LES FIBRES FUTURES consent à fournir les matériaux, la main-d’œuvre et la supervision nécessaires à la réalisation des travaux décrits à la présente convention.

Exclusions :

A) L’obtention d’un permis d’exécution des travaux est de la responsabilité du client. Les coûts pour l’émission de celui-ci, le cas échéant, sont à la charge du client.
B) Le client doit vérifier auprès de la ville si un permis d’occupation des lieux publics est requis.
À la demande du client, LES FIBRES FUTURES peut prendre en charge les démarches pour l’obtention des permis et la location de panneaux de signalisation. Les frais (factures à l’appui) seront ajoutés à la facture finale, avec frais de gestion.

Trois options :

  • Permis de rénovation uniquement
    → Coût total = Frais de gestion + Coût du permis
  • Permis d’occupation avec signalisation
    → Coût total = Frais de gestion + Permis + Signalisation
  • Permis de rénovation + occupation + signalisation
    → Coût total = Frais de gestion + Deux permis + Signalisation

C) Dessins d’atelier non scellés, sauf mention contraire.
D) Location de grue autre que celle de l’entreprise.
E) Travaux de menuiserie non spécifiés.
F) Frais de protection imposés par Hydro-Québec.
G) Amendes liées à un refus du client d’obtenir les permis requis.
H) Tous travaux non décrits au contrat.

Non-responsabilité de l’entrepreneur :

Aucun retard causé par des facteurs hors du contrôle de LES FIBRES FUTURES (ex. : météo, permis, matériaux, retards du client ou tiers) ne pourra engager sa responsabilité.
Si les travaux ne peuvent débuter dans les 30 jours suivant la date prévue, LES FIBRES FUTURES peut résilier le contrat par avis écrit. Le remboursement sera limité aux montants versés, moins les coûts engagés.

Prix et calendrier de paiement :

  1. Paiements exigibles selon le calendrier.
  2. Dépôt de 30 % à la signature du contrat.
  3. Paiement final de 70 % à la fin des travaux, à réception de la ou des factures.

Intérêts :

Un intérêt de 24 %/an s’applique à toute facture impayée après 30 jours.

Défaut :

LES FIBRES FUTURES peut résilier le contrat si :

  1. Le client ne respecte pas ses obligations.
  2. Le client cesse ses opérations (faillite, liquidation, etc.).
  3. Le client a un rapport de crédit défavorable.

Autres termes et conditions :

  • L’acier est livré avec apprêt rouge, à peindre par le client.
  • Prix budgétaire à valider lors d’une visite ou révision des plans.
  • Prix conditionnel à l’accès à la grue de l’entreprise.
  • Débris pris en charge par LES FIBRES FUTURES.
  • Le client doit retirer à ses frais tout obstacle (BBQ, thermopompe, etc.).
  • Le bois est naturel, à teindre ou peindre par le client.
  • Aucune garantie sur le bois ni sur les fissures de marches en pierre existantes.
  • Aucun autre travail inclus sauf mention contraire.
  • Délai pour dessins d’atelier : 3 à 6 semaines (si chantier prêt).
  • Délai d’installation : 10 à 12 semaines après approbation des dessins et permis.
  • Frais d’entreposage : 100 $/semaine si report de l’installation > 1 semaine.
  • Vacances et jours fériés exclus des délais.
  • Délais non garantis en cas de pénurie de matériaux.
  • Prix valide 10 jours, protégé à la signature et au dépôt de 30 %.
  • LES FIBRES FUTURES se réserve le droit d’annuler le contrat après vérification.


 

 

Agreement

Description of Work:

Unless otherwise specified, LES FIBRES FUTURES agrees to provide the materials, labor, and supervision necessary to carry out the work described in this agreement.

Exclusions:

A) Obtaining a work permit is the responsibility of the client. Any related costs, if applicable, are to be borne by the client.
B) The client must check with the city whether a public space occupancy permit is required.
At the client’s request, LES FIBRES FUTURES may handle the procedures for obtaining the necessary permits and renting signage panels for reserving parking spaces in front of the site. These costs (with supporting invoices) will be added to the final invoice, along with management fees.

Three options:

  • Renovation permit only
    → Total cost = Management fees + Renovation permit cost
  • Occupancy permit with signage
    → Total cost = Management fees + Occupancy permit + Signage
  • Renovation + Occupancy + Signage
    → Total cost = Management fees + Two permits + Signage

C) Shop drawings not sealed by an engineer, unless otherwise stated.
D) Crane rental other than the company’s own.
E) Carpentry work not specified in the contract.
F) Protection fees imposed by Hydro-Québec.
G) Fines resulting from the client’s refusal to obtain required permits.
H) Any other work not described in the contract.

Contractor’s Disclaimer:

LES FIBRES FUTURES shall not be held liable for any delays caused by factors beyond its control (e.g., weather, permits, materials, delays caused by the client or third parties).
If the work cannot begin within 30 days of the scheduled start date, LES FIBRES FUTURES may terminate the contract by written notice. Any refund will be limited to the amounts paid by the client, minus incurred costs.

Price and Payment Schedule:

  • Payments are due according to the agreed schedule.
  • A 30% deposit is payable upon signing the contract.
  • The final 70% payment is due upon completion of the work and receipt of the invoice(s).

Interest:

A 24% annual interest rate applies to any invoice unpaid after 30 days.

Default:

LES FIBRES FUTURES may terminate the contract if:

  • The client fails to meet contractual obligations.
  • The client ceases operations (bankruptcy, liquidation, etc.).
  • The client has an unfavorable credit report.

Other Terms and Conditions:

  • Steel is delivered with red primer and must be painted by the client.
  • Budgetary pricing to be confirmed during a site visit or plan review.
  • Price is conditional on access to the company’s crane.
  • Debris will be handled by LES FIBRES FUTURES.
  • The client must remove any obstacles (BBQ, heat pump, etc.) at their own expense.
  • Wood is delivered natural and must be stained or painted by the client.
  • No warranty on wood or cracks in existing stone steps.
  • No other work is included unless explicitly stated.
  • Lead time for shop drawings (not sealed): 3 to 6 weeks (if site is ready).
  • Installation lead time: 10 to 12 weeks after drawing approval and permit receipt.
  • Storage fees: $100/week if installation is postponed by more than one week.
  • Holidays and vacation periods are excluded from lead times.
  • Delays are not guaranteed in case of material shortages.
  • Price valid for 10 days and secured upon contract signing and 30% deposit.
  • LES FIBRES FUTURES reserves the right to cancel the contract after internal review.
